Terms of Use

These Terms of Use ("Terms") apply to your use of Regular for ADHD: Daily Self-Maintenance ("Regular") and Upkeep for ADHD: Recurring Life Maintenance ("Upkeep"), together referred to as "Regular & Upkeep."

By downloading, accessing or using Regular or Upkeep, you agree to these Terms.

If you do not agree to these Terms, please do not use the apps.

1. About Regular & Upkeep

Regular & Upkeep are tools designed to help people organise and complete recurring self-maintenance and life-maintenance activities. Regular is primarily designed for daily self-maintenance and regulation. Upkeep is primarily designed for recurring household, personal and life-maintenance activities.

The apps may provide features including reminders, notifications, checklists, recurring sessions, calendar integration, progress information and links or resources added by you.

Regular & Upkeep are designed particularly with ADHD in mind, but they are not medical products and are not intended to diagnose, treat, cure or prevent ADHD or any other medical or mental health condition.

2. Not medical advice

Regular & Upkeep are organisational and self-management tools. Nothing provided through the apps constitutes medical, psychological, psychiatric or other professional healthcare advice. The apps are not a substitute for professional medical advice, diagnosis or treatment.

If you have questions about medication, treatment, your health or a medical condition, you should seek advice from an appropriately qualified healthcare professional. You should not disregard professional medical advice or delay seeking it because of information, reminders or features provided through Regular or Upkeep.

3. Medication and other important reminders

You may choose to use Regular to remind yourself about medication, appointments or other important activities. Regular is a reminder and organisation tool only.

You remain responsible for following instructions provided by your doctor, pharmacist or other healthcare professional, including instructions about whether, when and how to take medication. You should not rely on Regular or Upkeep as your sole method of remembering medication, medical appointments, safety-critical activities or anything where a missed notification could cause serious harm.

Notifications and reminders may be delayed, suppressed or fail because of device settings, operating-system behaviour, connectivity, calendar configuration, software errors or other circumstances outside our control.

4. Your content and information

You may add information to Regular & Upkeep, including session names, checklist items, notes, links, schedules and other content. You retain ownership of content you create.

You are responsible for the information you choose to enter and for ensuring that you have the right to use or store any content you add. Please consider the sensitivity of information you enter, particularly information relating to your health, medication or other personal matters.

5. Calendar integration

Regular & Upkeep may allow you to create or manage events in an external calendar. Calendar integration is provided for convenience and depends on the permissions, availability and behaviour of your device and relevant calendar provider.

You are responsible for checking that events have been created correctly and that dates, times, recurrence settings and other information are accurate. Removing Regular or Upkeep, disconnecting calendar access or changing a session within an app may not automatically remove information that has already been stored by an external calendar service.

6. Notifications

Regular & Upkeep may provide notifications and reminders where you enable them. We cannot guarantee that any particular notification will be delivered at a specific time or delivered at all. Your device settings, notification permissions, operating system and other technical factors can affect notification delivery. You remain responsible for activities that you schedule through the apps.

7. Purchases

Regular and Upkeep may be offered as paid apps, in-app purchases, bundled purchases, free trials, promotional offers or through other purchasing arrangements. Prices and available offers may vary by country, platform and time.

Where a purchase is made through Apple's App Store, the transaction is processed by Apple and is also subject to the applicable App Store terms. We do not receive or store your complete payment card information when Apple processes your purchase.

8. Refunds

Purchases made through Apple's App Store are subject to Apple's applicable payment and refund policies. Where Apple controls the transaction, requests for refunds should be made through Apple. Nothing in these Terms limits any refund, cancellation or other consumer rights that you are entitled to under applicable law.

9. Free versions and trials

We may offer free versions, web versions, trials, beta access or promotional access to Regular or Upkeep. The features, duration and availability of free or promotional access may change. Where a trial converts into a paid purchase, any payment terms and required disclosures will be shown before you agree to the purchase.

10. Beta and test versions

We may make pre-release or test versions of Regular & Upkeep available, including through services such as TestFlight. Beta software may contain bugs, incomplete features or functionality that changes during testing.

If you participate in testing, you may choose to provide feedback about your experience. Unless otherwise agreed, we may use that feedback to develop and improve Regular & Upkeep without an obligation to compensate you. You should not rely on beta versions for safety-critical or medically important activities.

11. Acceptable use

You agree not to:

• use Regular or Upkeep for unlawful purposes
• interfere with the operation or security of the apps
• attempt to gain unauthorised access to systems or data
• reverse engineer, copy or redistribute the apps except where applicable law expressly permits it
• use automated systems to access or disrupt the services in an unreasonable manner
• infringe our intellectual property rights or the rights of another person

12. Intellectual property

Regular & Upkeep, including their software, design, branding, visual elements and original content, are owned by us or licensed to us and are protected by applicable intellectual property laws.

These Terms give you a personal, limited, non-exclusive, non-transferable right to use the apps for their intended purposes. They do not transfer ownership of the apps or our intellectual property to you.

13. Third-party services and links

Regular & Upkeep may interact with third-party products or services, including calendars, websites, videos or other resources. You may also choose to add your own external links to sessions or activities.

We do not control third-party services and are not responsible for their availability, content, security or privacy practices. Your use of a third-party service may be subject to that provider's own terms and privacy policy.

14. Availability and changes

We want Regular & Upkeep to work reliably, but we cannot guarantee uninterrupted or error-free availability. We may fix bugs, update features, change functionality or make other reasonable modifications as the products develop. We may discontinue a feature or service where reasonably necessary.

Where a material change significantly affects something you have purchased, we will respect any rights you have under applicable consumer law.

15. Disclaimer

To the extent permitted by law, Regular & Upkeep are provided on an "as available" basis. We do not guarantee that using the apps will cause you to complete every activity, maintain a routine, improve productivity, improve symptoms of ADHD or achieve any particular personal outcome.

Regular & Upkeep are tools. How useful they are will depend on your circumstances and how you choose to use them. Nothing in these Terms excludes warranties, guarantees or other rights that cannot lawfully be excluded.

16. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to those protections and to the extent permitted by applicable law, we are not responsible for losses caused by:

• your reliance on a notification or reminder as the sole means of remembering something important
• incorrect information entered by you
• third-party services or external links
• circumstances outside our reasonable control
• use of the apps in a way they were not designed or intended to be used

If you are a consumer, nothing in these Terms affects your statutory consumer rights.

17. Ending your use

You can stop using Regular or Upkeep at any time. You can remove the apps from your device and revoke permissions such as calendar or notification access through your device settings. Deleting an app may not automatically delete information already stored in an external service, such as calendar events.

18. Changes to these Terms

We may update these Terms from time to time to reflect changes to Regular & Upkeep, our business, applicable law or regulatory requirements. If we make a material change, we will provide reasonable notice where required. The date at the top of this page shows when these Terms were most recently updated.

19. Governing law

These Terms are governed by the laws of England and Wales, except where the mandatory consumer protection laws of the country in which you live provide otherwise. If you are a consumer, you may also have rights to bring proceedings in the courts available to you under applicable consumer law.
